Terms of Service

By using Whale DNA you agree to these Terms of Service. Please read them carefully — they explain important things about how the service works and what it is not.

1. What Whale DNA is

Whale DNA is an educational information service that reads public scientific literature and databases (ClinVar, PharmGKB, SNPedia) and cross-references them with data you choose to upload. We return plain-English insights and suggestions for discussion with your doctor.

2. What Whale DNA is not

Whale DNA is not a medical device, medical service, telemedicine platform, or a replacement for professional medical advice, diagnosis or treatment. No content on this site, and no generated report, constitutes medical advice. We do not establish a doctor–patient relationship.

Always seek the advice of a qualified health provider with any questions about a medical condition or treatment. Never disregard professional medical advice or delay seeking it because of something you read in a Whale DNA report.

3. Eligibility

You must be at least 18 years old to use Whale DNA. You must have the legal right to upload any data you upload (in particular, you must own or have permission to process any individual's genetic data).

4. Accounts

Accounts are created via magic-link email authentication. You are responsible for the security of your inbox. If you lose access to your email, we can delete the account but cannot transfer it.

5. Payments

• Detailed reports are one-time purchases, currently priced at USD 10.00 (excluding VAT).
• Payments are processed by Stripe. Prices may change with 30 days notice.
• Refunds: since reports are delivered instantly, we do not offer refunds once a report has been generated. If the report fails to generate due to our error, we will retry or refund in full.

6. Acceptable use

You agree not to:

• Upload data you do not own or have consent to process.
• Attempt to re-identify other users or reverse-engineer the service.
• Resell Whale DNA reports as medical services or under a different brand.
• Submit automated traffic or abusive requests.

7. Intellectual property

The Whale DNA platform, brand and analysis engine are our property. Your reports are yours — you may download, print and share them freely. The scientific databases we reference are owned by their respective custodians (NIH/ClinVar, PharmGKB/Stanford, etc.).

8. Disclaimer of warranties

Whale DNA is provided "as is", without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that it will identify every relevant genetic or laboratory finding. Genetic associations are probabilistic and scientific understanding evolves.

9. Limitation of liability

To the maximum extent permitted by law, Whale DNA, its officers, employees and affiliates shall not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, data, or health outcomes arising out of or relating to the use of the service. Our aggregate liability in any event is limited to the amount you paid us in the preceding 12 months.

10. Indemnification

You agree to indemnify and hold harmless Whale DNA from claims arising out of your misuse of the service or violation of these Terms.

11. Termination

You may close your account at any time. We may suspend or terminate accounts for violation of these Terms or illegal activity, with reasonable notice where practicable.

12. Governing law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved in the courts of Warsaw, unless consumer-protection rules in your country of residence provide otherwise.

13. Changes

We may update these Terms. Material changes will be notified by email 30 days in advance. Continued use after the effective date constitutes acceptance.
